1. Interpretation and Definitions

The words with capitalised initial letters have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

3. Orders
By placing an Order through the Service, You confirm that You are legally capable of entering into binding contracts and that the information You provide is accurate and complete.
We may require You to provide details including name, email, billing and shipping address, and payment information to complete an Order. By providing this information, You authorise Us to share it with payment providers for processing.
4. Pricing and Payments
• Prices are listed in Australian Dollars (AUD) unless otherwise stated.
• We reserve the right to change prices at any time before an Order is accepted.
• Payment must be received in full before Goods are dispatched or digital content is made available.
• Accepted payment methods may include Visa, MasterCard, American Express, PayPal and other options displayed at checkout.
Subscriptions
Certain services are offered on a subscription basis. By purchasing a subscription, You authorise Us to charge the applicable subscription fee to Your nominated payment method on a recurring basis (e.g., monthly) until cancelled.
Subscription fees are charged for access to the service and management activities provided, not for guaranteed outcomes such as a specific number of new reviews.
All subscription payments are charged in advance for the upcoming billing period. Once a payment has been processed, no refunds will be provided for that period, except where required by the Australian Consumer Law. Refunds are not provided for change of mind, unused services, or cancellations part-way through a billing cycle. However, you are entitled to a refund or other remedy under the Australian Consumer Law if the service is not provided as described, is substantially unfit for purpose, or otherwise constitutes a major failure under the ACL.
You may cancel Your subscription at any time by contacting Us. Cancellation will take effect at the end of the current billing cycle, and no further payments will be taken.
5. Cancellations, Refunds and Consumer Rights
Our separate Refund and Cancellation Policy applies to Orders.
Nothing in these Terms limits or excludes any rights, guarantees, or remedies available to You under the Australian Consumer Law.
You are entitled to a replacement, repair, or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have Goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Certain Goods are not eligible for cancellation or refund unless required by law, including:
• Personalised or custom-made Goods;
• Perishable Goods;
• Goods unsealed for health or hygiene reasons;
• Goods inseparably mixed with other items after delivery;
• Digital content (once access has been provided) where You expressly consented to waive Your cancellation rights.
For digital services and subscription products, once access has been provided or the first service delivered, no refunds will be given except as required under the Australian Consumer Law.
6. Availability and Errors
We make reasonable efforts to ensure information on Our Website is accurate. However, errors (including pricing errors) may occur, and Goods may be unavailable. We reserve the right to correct errors and update information at any time without notice.
7. Intellectual Property
All content, trademarks, logos, and designs on the Service remain the property of the Company or its licensors. You may not copy, reproduce, or use them without Our prior written consent, except as permitted under Australian copyright law.
8. Third-Party Links
Our Service may include links to third-party websites or services. We are not responsible for the content, policies, or practices of these third parties and You access them at Your own risk.
9. Limitation of Liability
To the maximum extent permitted by law:
• We exclude all liability for any loss, damage, cost, or expense (whether direct or indirect) arising from Your use of the Service, except where such liability cannot be excluded under the ACL.
• Where liability under the ACL cannot be excluded, Our liability is limited (at Our option) to:
• replacement of the Goods or supply of equivalent Goods;
• repair of the Goods;
• payment of the cost of replacing or repairing the Goods; or
• resupplying the Service.
Nothing in these Terms excludes or limits consumer guarantees under the ACL.
10. Termination
We may suspend or terminate Your access to the Service at any time if You breach these Terms. Upon termination, Your right to use the Service ceases immediately.
11. Governing Law
These Terms are governed by the laws of South Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of South Australia.
12. Dispute Resolution
If You have a concern or complaint, You agree to contact Us first to attempt informal resolution. If not resolved, disputes may be referred to the courts of South Australia.
13. Changes to These Terms
We may update these Terms from time to time. If material changes are made, We will notify users by updating the date at the top of this page and/or providing notice on the Website. By continuing to use the Service, You agree to the revised Terms.
